1. Introduction

These Terms of Service (“Terms”) govern your use of The Drummer’s Way(thedrummersway.com) website (“Site”) and the services we offer (“Services”). By accessing or using our Site and Services, you agree to be bound by these Terms.

2. Services Provided

The Drummer’s Way offers 1-on-1 online drum lessons via Zoom. Lessons are available in 30-minute and 1-hour sessions, and packaged can be bought with a balance of time that can be used to book lessons.

3. Trial Lesson

• 30-Minute Trial Lesson: The 30-minute trial lesson is offered free of charge and is available only once per person. This trial is intended to allow prospective students to experience our teaching style and discuss their goals.

• Limitations: The trial lesson can only be booked once by each individual. Any attempt to book multiple trial lessons by the same person will be declined.

4. Packages

• Package Options: You can purchase lesson packages with a balance of 4, 12, or 24 hours. These hours can be used to book lessons according to your needs. At checkout, you will be prompted to select your purchased package in the “Package, Gift, or Code” section. The time of the lessons you are booking will be deducted from your package balance.

• Using a Package: If you’re logged into your account, the package will be automatically applied at checkout. If you are not logged in, you will need to use the package code you received in the confirmation email as a discount code.

• Balance Expiry: The balance of your package never expires and can be used flexibly to book one or more lessons at a time until the balance is used up.

5. Booking Lessons

• No Account Required: You do not need to create an account to book a lesson. Bookings are made directly through our website by providing the necessary contact details.

• Booking Process: Upon booking a lesson, you will receive a confirmation email with details on how to join the lesson via Zoom.

6. Payment, Refunds, rescheduling & cancellation policy

• Payment: All payments are processed securely through Squarespace’s integrated payment systems(PayPal & stripe) at the time of booking.

• Refund Policy: All lesson payments are non-refundable. If you need to cancel a lesson, you will receive a lesson credit valid for future bookings. Cancellations with at least 12 hours notice: Your payment will be converted into a lesson credit that can be applied to another lesson. Cancellations with less than 12 hours notice or no-shows: no lesson credit will be granted and full fees will apply. Lesson credits are valid for 12 months from the date of the original booking and can be applied toward any future lessons. The cancellation of a lesson booked using the balance of a package will result in the balance being returned to your package balance and not in a monetary refund. Packages cannot be refunded.

• Cancellation and Rescheduling Policy: You can reschedule or cancel your lesson up to 12 hours before the scheduled lesson time. After this period, full fees apply, and you may not reschedule or cancel the lesson. In cases of emergency, the rescheduling or cancellation policy may be waived at the discretion of The Drummer’s Way.

7. Use of Zoom

Our lessons are conducted via Zoom. You do not need to download any software; you can join the lesson via the link we provide. However, it is your responsibility to ensure you have a stable internet connection and the necessary equipment.

8. User Conduct

You agree to use our Site and Services in a lawful and respectful manner. Any misuse of our Services, including disruptive behavior during lessons, may result in the termination of your access to our Services without a refund.

8. Intellectual Property

All content provided on the Site, including videos, lesson plans, and materials, is the intellectual property of The Drummer’s Way. You may not reproduce, distribute, or use this content without our express written permission.

9. Limitation of Liability

The Drummer’s Way is not liable for any damages that may arise from your use of our Services, including technical issues or lesson disruptions. Our maximum liability is limited to the amount you have paid for our Services.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated “Effective Date” and will be effective as soon as it is accessible.
